Terms of Service

Welcome to JoyWaveDigital. These Terms of Service (the "Terms") govern your access to and use of the website at joywavedigital.in (the "Site"), the digital products sold through the Site (the "Products"), and any related services. By using the Site or purchasing a Product, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

JoyWaveDigital is a sole proprietorship operated from India by an individual seller. We are reachable at hello@joywavedigital.in.

These Terms work together with our Privacy Policy, which describes how we collect, use, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

1. Products and license grant

The Products are digital printables (worksheets, flashcards, activity packs, and similar PDF-format educational materials). When you complete a purchase, JoyWaveDigital grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Product as follows:

• Personal and classroom use. You may print, copy, and distribute the Product to your own children, students, or learners. A single-classroom teacher may print copies for the students in that classroom each year.
• No resale or redistribution. You may not sell, sublicense, or share the Product or its digital files outside the personal or classroom context above. You may not upload the Product to any file-sharing service, marketplace, or public website.
• No derivative works for resale. You may not extract artwork, fonts, or other component assets from a Product to create derivative works that you sell or redistribute.
• School or district licensing. Multi-classroom and district-wide licenses are available on request. Please email hello@joywavedigital.in with the number of teachers or students involved and we will quote a site license.

The license takes effect once payment is confirmed and continues for as long as you comply with these Terms. If you breach the license, we may revoke it and require you to delete all copies of the Product.

2. Pricing, currency, and payment

All Product prices are quoted on the Site in US Dollars (USD). For your convenience, the Site may display an approximate price in your local currency based on your IP-derived region and a published exchange rate. The local-currency display is informational only; checkout is processed in USD or the local currency that our payment processor determines for your region, and the amount you are actually charged may differ slightly from the displayed approximation due to exchange-rate movement and processor markup.

Payments are processed by Dodo Payments (dodopayments.com), which acts as the Merchant of Record for transactions on the Site. That means Dodo Payments is the seller of record on your statement and handles tax calculation, tax collection, and tax remittance for the relevant jurisdictions (including US sales tax, EU VAT, UK VAT, and GST regimes where applicable). The price you see at checkout includes any taxes that Dodo Payments determines apply to your purchase.

We do not see or store your full payment card number, CVV, or any other primary payment instrument data. Dodo Payments handles that data under its own PCI-DSS certified infrastructure.

3. Refunds

Because the Products are digital goods delivered immediately upon purchase, all sales are generally final once the download has been accessed. We offer a refund in the following circumstances:

• Broken or unusable file. If the file you downloaded is corrupted, will not open, or is materially different from what the Product page described, email hello@joywavedigital.in within 30 days. We will first try to fix it. If we cannot, we will refund the full purchase price.
• Duplicate purchase. If you accidentally purchased the same Product twice within the same week, email us and we will refund the duplicate.
• EU and UK statutory withdrawal. If you are a consumer based in the European Union or the United Kingdom, you have a 14-day right of withdrawal from the date of purchase under the Consumer Rights Directive 2011/83/EU. This right does not apply once you have started downloading or accessing the digital content, because you expressly consent to immediate delivery and acknowledge the loss of the withdrawal right at checkout. If you have not yet downloaded, you may withdraw and receive a full refund by emailing hello@joywavedigital.in within 14 days.

Refund requests are reviewed individually. We aim to respond within three business days. Approved refunds are returned to the original payment method via Dodo Payments and typically appear on your statement within 5 to 10 business days.

4. Intellectual property and DMCA

All Products, including artwork, layouts, typography, and the underlying source files, are owned by JoyWaveDigital or licensed to it from third-party creators with appropriate commercial use rights. The Site itself (including its name, logo, design, code, and editorial content) is also owned by JoyWaveDigital.

You may use Products under the license described in Section 1. All other rights are reserved. Nothing in these Terms transfers ownership of any intellectual property to you.

If you believe a Product or any content on the Site infringes your copyright, please send a written notice to hello@joywavedigital.in containing: (a) identification of the copyrighted work claimed to be infringed, (b) identification of the allegedly infringing material on the Site (URL and a description), (c) your contact information (address, phone, email), (d) a statement that you have a good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf, and (f) your physical or electronic signature. We will review all valid notices and take down infringing material as appropriate under applicable copyright law (including the US Digital Millennium Copyright Act).

5. Acceptable use and account termination

You agree not to:

• Use the Site or any Product for any illegal, harmful, fraudulent, or deceptive purpose.
• Attempt to disrupt the Site, bypass its security measures, scrape it at scale, or probe for vulnerabilities without our prior written permission.
• Use automated systems (bots, crawlers) to access the Site in a way that exceeds normal human use, except for well-behaved search-engine crawlers that respect robots.txt.
• Misrepresent your identity, impersonate another person, or create an account with false information.
• Share account credentials, signed download URLs, or Product files outside the license granted in Section 1.

We may suspend or terminate your access to the Site or to specific Products at any time, with or without notice, if we believe you have violated these Terms or have abused our services. Where it is safe and lawful to do so, we will try to give you notice and a chance to cure. On termination, your license to use Products acquired through the Site ends and you must delete all copies of those Products.

6. Disclaimers and limitation of liability

The Products and the Site are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, JoyWaveDigital disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

The Products are intended to support learning and educational activities. They are not a substitute for professional teaching, tutoring, therapy, medical advice, or any other professional service. Any educational outcome depends on how the Products are used and on factors outside our control.

To the maximum extent permitted by applicable law, JoyWaveDigital, its owner, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Site or any Product. Our total cumulative liability to you for any claim relating to a Product will not exceed the amount you paid us for that Product in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted by law, and nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law.

7. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the use of the Site or Products will be subject to the exclusive jurisdiction of the courts located in India.

If you are a consumer based in a jurisdiction whose mandatory consumer protection laws give you the right to bring a dispute in your local courts or to apply your local consumer law, nothing in this section removes that right.

Before filing any formal dispute, please contact us first at hello@joywavedigital.in. We commit to working with you in good faith to resolve the issue informally within 30 days of receiving notice.

8. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features, new payment options, or changes in applicable law. When we do, we will update the "Last updated" date at the top of this page. For material changes (such as changes that affect refund rights, pricing terms, or your data), we will give you reasonable advance notice, typically by email or by a notice on the Site.

Continued use of the Site after the effective date of the updated Terms constitutes acceptance of the changes.
